To extend your lease under the Leasehold Reform, Housing and Urban Development Act 1993, the premium you offer your freeholder in your Section 42 Notice must be supported by a professional valuation. Offer too little and your freeholder may reject it. Offer too much and you pay more than you need to. Leasehold valuation is a specialist field. Calculating the premium is undertaken using a set of quantitative formulas that include your property’s value, the unexpired term of your lease, your ground rent, relativity and, where the lease has fallen below 80 years, marriage value. It should also includes qualitative elements, judgement: knowledge of comparable settlements, recent tribunal decisions and, often, the freeholder on the other side of the negotiation.
